Terms and Conditions for FlowTrigger

1. Agreement to Terms

By downloading, installing, accessing, or using the FlowTrigger mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

1.1 Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) to use this App. By using the App, you represent and warrant that:

• You are at least 13 years old (or 16 in the EEA)
• You have the legal capacity to enter into a binding agreement
• Your use of the App does not violate any applicable law or regulation

1.2 Acceptance

Your continued use of the App constitutes your acceptance of these Terms and any future modifications.

2. Description of Service

2.1 What FlowTrigger Does

FlowTrigger is an automation trigger application that allows you to send HTTP requests to webhook endpoints. The App connects to automation platforms such as n8n, Make, Zapier, and any other service that accepts HTTP webhook requests.

2.2 Available Trigger Types

The App provides the following trigger mechanisms:

• Manual Triggers: Send text input (typed or voice-to-text), captured photos, or audio recordings
• Chat Interface: Interactive chat with LLMs hosted in your automation workflows
• Notification Triggers: Trigger workflows based on phone notifications (Premium)
• Location Triggers: GPS geofence-based triggers and location updates (Premium)

2.3 Free vs Premium Features

2.4 No User Accounts

FlowTrigger does not require user accounts. All data you enter into the App stays in the App's local database or is sent to URLs that you define via HTTP requests.

3. User Responsibilities

By using the App, you agree to:

3.1 Webhook Configuration

• Configure webhooks only to services and endpoints you own or have authorization to use
• Verify the security and trustworthiness of webhook destinations before configuration
• Understand that data sent to webhooks is transmitted to third-party services outside our control

3.2 Lawful Use

• Use the App and any automations you create in compliance with all applicable laws
• Ensure your automated workflows do not violate the terms of service of connected platforms
• Take responsibility for the content and data you send through webhooks

3.3 Data Responsibility

• You are solely responsible for all data you input, record, capture, or transmit through the App
• You must have appropriate rights to any content you send via webhooks
• You are responsible for backing up any important data

3.4 Device Security

• Maintain the security of your device
• Protect access to the App and your configured webhooks
• Promptly update the App when updates are available

4. License Grant

4.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal mobile device
• Use the App for personal, non-commercial purposes
• Access and use Premium features if you have purchased them

4.2 Restrictions

You may not:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, disassemble, or attempt to derive the source code
• Remove, alter, or obscure any proprietary notices
• Sell, rent, lease, sublicense, distribute, or transfer the App
• Use the App for commercial purposes without authorization
• Use automated scripts or bots to interact with the App
• Circumvent any technical limitations or usage restrictions

5. Premium Features and Payments

5.1 Premium Purchase

Premium features are available through a one-time purchase providing lifetime access to all premium features. The price is subject to change.

5.2 Payment Processing

All payments are processed through Google Play Billing. By making a purchase:

• You agree to Google Play's Terms of Service
• You authorize the charge to your selected payment method
• You acknowledge that we do not process or store payment information directly

5.3 Refunds

Refunds are handled according to Google Play's refund policies. We do not have the ability to process refunds directly. For refund requests:

• Contact Google Play support within their refund window
• Follow Google's refund procedures

5.4 Feature Availability

We reserve the right to modify Premium features over time. If we significantly reduce Premium functionality, existing Premium users will receive reasonable notice.

6. Prohibited Uses

You agree not to use the App to:

6.1 Illegal Activities

• Violate any applicable local, state, national, or international law
• Transmit illegal content or facilitate illegal activities
• Engage in fraud, money laundering, or other financial crimes

6.2 Harmful Activities

• Send spam, unsolicited messages, or bulk communications
• Harass, abuse, threaten, or intimidate any person
• Distribute malware, viruses, or other harmful code
• Conduct phishing or other deceptive practices

6.3 Unauthorized Access

• Attempt unauthorized access to any systems or networks
• Circumvent security measures of third-party services
• Exceed authorized access to connected automation platforms
• Bypass the App's usage limits or restrictions

6.4 Service Abuse

• Interfere with or disrupt the App's functionality
• Overload or attempt to overload infrastructure
• Use the App in ways that could harm other users

7. Intellectual Property

7.1 Our Ownership

The App, including all content, features, functionality, design, code, graphics, logos, and trademarks, is owned by FlowTrigger and is protected by copyright, trademark, and other intellectual property laws.

7.2 Your Content

You retain all rights to content you create, input, record, or capture using the App ("Your Content"). This includes text, voice recordings, photos, and trigger configurations.

7.3 License to Your Content

By using the App, you grant us a limited, non-exclusive license to process Your Content solely for the purpose of providing the App's functionality (i.e., transmitting data to your configured webhooks). We do not access, store, or use Your Content for any other purpose.

7.4 Feedback

If you provide suggestions, ideas, or feedback about the App, you grant us the right to use such feedback without restriction or compensation.

8. Third-Party Services

8.1 Integrated Services

The App integrates with the following third-party services:

• Firebase Analytics (Google): For app usage analytics
• Firebase Crashlytics (Google): For crash reporting and diagnostics
• Google Play Billing: For payment processing

8.2 User-Configured Services

You may configure the App to connect to third-party webhook endpoints including but not limited to:

• n8n
• Make (formerly Integromat)
• Zapier
• Custom webhook endpoints

8.3 Third-Party Terms

Your use of third-party services is subject to their respective terms of service and privacy policies. We are not responsible for:

• The availability, security, or reliability of third-party services
• Actions taken by third-party services with data you send
• Changes to third-party services that affect App functionality
• Any damages resulting from your use of third-party services

8.4 No Endorsement

Integration with or compatibility with third-party services does not constitute our endorsement or recommendation of those services.

9. Disclaimers

9.1 "As Is" Provision

The app is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness

9.2 No Guarantee of Service

We do not warrant that:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, secure, or error-free
• Webhook transmissions will always be successful
• Results from using the App will be accurate or reliable
• Any errors in the App will be corrected

9.3 Webhook Reliability

You acknowledge that:

• Webhook delivery depends on network conditions and third-party services
• We cannot guarantee successful delivery to your configured endpoints
• Delays or failures in webhook transmission may occur
• You are responsible for monitoring the success of your automations

9.4 Automation Outcomes

We are not responsible for the outcomes of automations triggered by the App, including:

• Actions taken by connected automation platforms
• Consequences of automated workflows you configure
• Errors or unintended results from your automation logic

10. Limitation of Liability

10.1 Exclusion of Damages

To the maximum extent permitted by law, in no event shall we be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Personal injury or property damage
• Any damages arising from:
  • Your use or inability to use the App
  • Unauthorized access to or alteration of your data
  • Actions of third-party services
  • Errors or omissions in any content
  • Any matter relating to the App

10.2 Liability Cap

Our total liability for any claims arising from or relating to these terms or the app shall not exceed the amount you paid for the app in the twelve (12) months preceding the claim, or $9.99 USD, whichever is greater.

10.3 Essential Purpose

The limitations in this section apply even if any remedy fails of its essential purpose.

10.4 Jurisdictional Variations

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless FlowTrigger, and any affiliates, officers, agents, and employees from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you transmit through the App
• Your webhook configurations and the actions triggered by them
• Any automations or workflows you create
• Your use of third-party services accessed through the App

12. Termination

12.1 Termination by You

You may stop using the App at any time by:

• Uninstalling the App from your device
• Deleting your local data through device settings

12.2 Termination by Us

We may suspend or terminate your access to the App at any time, without prior notice, for:

• Violation of these Terms
• Conduct that we determine to be harmful to other users or the App
• Any reason at our sole discretion

12.3 Effect of Termination

Upon termination:

• Your license to use the App immediately ends
• You must stop all use of the App
• We have no obligation to retain or provide your data
• Sections that by their nature should survive termination will survive (including Disclaimers, Limitation of Liability, and Indemnification)

12.4 No Refunds on Termination

If we terminate your access due to violation of these Terms, you are not entitled to any refund for Premium features.

13. Governing Law and Disputes

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Delaware, United States, without regard to conflict of law principles.

13.2 Informal Resolution

Before initiating formal dispute resolution, you agree to first contact us at contact@flowtrigger.app to attempt to resolve any dispute informally. We will attempt to resolve disputes within 30 days.

13.3 Jurisdiction

For any disputes not resolved informally, you agree to submit to the exclusive jurisdiction of the courts located in Delaware, United States.

13.4 Class Action Waiver

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

13.5 Time Limitation

Any claim or cause of action arising from or relating to these Terms or the App must be filed within one (1) year after such claim or cause of action arose, or it shall be forever barred.

14. Changes to Terms

14.1 Right to Modify

We reserve the right to modify these Terms at any time. Changes will be effective when posted.

14.2 Notification of Changes

We will notify you of material changes by:

• Updating the "Last Updated" date at the top of these Terms
• Displaying an in-app notification for significant changes
• Posting the updated Terms in the App

14.3 Continued Use

Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the App.

15. General Provisions

15.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

15.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.

15.6 Headings

The section headings in these Terms are for convenience only and have no legal or contractual effect.
